Agreement to Terms

By accessing or using the services of XULEXPRESS & EXPRESSLANE ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all users of our services, including but not limited to parents, guardians, students, and anyone who accesses or uses our transport services, website, WhatsApp chatbot, or any other services we provide.

Important: These Terms constitute a legally binding agreement. Please read them carefully before using our services.

Our Services

XULEXPRESS & EXPRESSLANE provides comprehensive transport services in Mutare, Zimbabwe. Our services include:

1. Scholar Transport (XULEXPRESS)

School pickup and drop-off services exclusively for Hillcrest Prep and College
Coverage areas: Palmerstone, Greenside, Darlington, Murambi, Morningside, Florida, Fairbridge, Yeovil, Westlea, Town, Chikanga, St Joseph
Regular, scheduled transport for students
SMS notification service for drop-offs
Real-time tracking through our Transport Management System

2. Private Hire (EXPRESSLANE)

Half-day and full-day vehicle hire within Mutare
Trips outside Mutare (e.g., Vumba, Nyanga, Harare)
Special events (tours, weddings, funerals, corporate events)
Vehicle options: Minibus/Van (9 or 18 seater) or Bus (26 or 29 seater)
Dry Rate (vehicle only) and Wet Rate (vehicle and fuel) options

3. Taxi Service

On-demand transportation services
Immediate booking and dispatch
Point-to-point transport

Pricing and Payment Terms

Scholar Transport Pricing

One Way Trip	Either morning pickup or afternoon drop-off only	$35 per child per month
Two Way Trip	Complete pickup and drop-off service	$70 per child per month

Payment Terms

All fees are payable in advance or as agreed in your service contract
Monthly services must be paid by the 5th of each month
Late payment fees may apply at 5% per month on outstanding balances
We accept cash, bank transfers, and other agreed payment methods
All prices are quoted in USD (US Dollars) unless otherwise stated
Prices are subject to change with 30 days written notice

Private Hire and Taxi Pricing

Rates are quoted based on distance, duration, vehicle type, and fuel requirements
Quotes are valid for 7 days from the date of issue
A deposit may be required to confirm bookings
Full payment is required before or upon service completion
Additional charges may apply for overtime, extra mileage, or special requests

Booking and Cancellation Policy

Registration and Booking

Scholar transport registration requires completion of our registration form with accurate information
Private hire bookings can be made via WhatsApp chatbot, phone, or email
A booking confirmation will be provided upon successful registration
We reserve the right to refuse service if information is incomplete or inaccurate

Cancellation by Customer

Scholar Transport: Requires 30 days written notice for permanent cancellation
Private Hire: Free cancellation up to 48 hours before service
Same-Day Cancellations: 50% cancellation fee applies if cancelled less than 24 hours before service
No-Show: Full payment is required for no-show situations

Cancellation by Us

We reserve the right to cancel services due to:

Vehicle mechanical issues or breakdowns
Driver unavailability due to illness or emergencies
Severe weather conditions or natural disasters
Unsafe road conditions
Government restrictions or lockdowns

We will provide maximum notice possible and offer alternative arrangements where feasible
Full refunds will be provided if we cancel and cannot provide alternative service

Important: In case of emergency cancellations on our part, we will make every effort to notify you as soon as possible and arrange alternative transport when available.

Safety and Conduct

Safety Requirements

All passengers must follow driver instructions and safety guidelines
Children must be properly seated and restrained at all times
Children under a certain age must use approved child safety seats (to be provided by parents if required)
Standing in moving vehicles is strictly prohibited
Eating, drinking, or littering in vehicles is not permitted
Windows must remain closed or partially open as instructed by the driver

Conduct and Behavior

All passengers must treat drivers and other passengers with respect
Any form of bullying, harassment, or disruptive behavior is strictly prohibited
Violence, threats, or abusive language will result in immediate service termination
Parents/guardians are responsible for their children's behavior
We reserve the right to refuse service to disruptive passengers

Smoking and Prohibited Items

Smoking, vaping, or the use of tobacco products is strictly prohibited
Alcohol and illegal substances are not allowed on vehicles
Weapons of any kind are strictly prohibited
Hazardous materials are not permitted

Driver and Vehicle Safety

All drivers are licensed, vetted, and undergo regular training
Vehicles are serviced regularly and maintained to safety standards
We maintain insurance coverage for all vehicles and passengers
Drivers are required to follow all traffic laws and safety regulations

Liability and Insurance

Insurance Coverage

We maintain comprehensive insurance coverage for all vehicles
Passenger liability insurance is in place for all services
Insurance coverage is subject to the terms and conditions of our insurance policies

Limitation of Liability

Our liability is limited to the extent permitted by applicable law
We are not responsible for delays caused by traffic, weather, or other circumstances beyond our control
We are not liable for items left, lost, or stolen from vehicles
Parents/guardians are responsible for their children's belongings
We are not responsible for indirect, incidental, or consequential damages

Parental Responsibility

Parents/guardians are responsible for ensuring their child is ready for pickup
If a child is not ready or not present at the scheduled pickup time, the driver may proceed without the child
Parents must provide accurate contact information and update us of any changes
Emergency contact information must be kept current

Medical Emergencies

In case of medical emergency, we will seek immediate medical attention
Parents/guardians are responsible for their child's medical expenses
We will provide transportation to the nearest medical facility if needed

Important: While we take all reasonable precautions to ensure safety, accidents can occur. Our insurance coverage provides protection within the bounds of our policy terms.

Data Protection and Privacy

Your privacy is important to us. We collect and use personal information in accordance with our Privacy Policy. Key points:

We collect necessary information for service delivery and safety
Personal information is stored securely and not shared with third parties without consent
SMS notifications may be sent to parents for service updates
We use location tracking for vehicle monitoring and safety purposes

WhatsApp Chatbot

Information provided through our WhatsApp chatbot is used for service provision
Chat logs are retained for service improvement and customer support purposes
Your phone number is required for WhatsApp communications

Intellectual Property

All content, trademarks, logos, and intellectual property on our website, marketing materials, and services are the property of XULEXPRESS & EXPRESSLANE and are protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or use our intellectual property without written permission
Our branding and logos may not be used without authorization
Photographs and testimonials may be used with your consent for marketing purposes

Prohibited Activities

The following activities are strictly prohibited:

Using our services for illegal purposes
Damaging or vandalizing vehicles
Interfering with vehicle equipment or GPS systems
Harassing drivers, staff, or other passengers
Providing false or misleading information
Attempting to circumvent our booking or payment systems
Sharing or selling your account or booking details
Using our services to transport prohibited items or substances

Consequences: Violation of these prohibitions may result in immediate service termination, legal action, and/or reporting to relevant authorities.

Dispute Resolution

Complaint Procedure

We will investigate your complaint within 48 hours
We will provide a written response within 7 business days
If unresolved, we will work with you to find a mutually acceptable solution

Mediation and Arbitration

Any disputes will first be addressed through direct communication
If unable to resolve, parties agree to attempt mediation
Any arbitration proceedings will be conducted under Zimbabwean law
These Terms are governed by the laws of Zimbabwe

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. We will notify you of material changes through:

Email notification (if you have provided your email address)
Notice on our website and WhatsApp chatbot
Updated "Last Updated" date at the top of this document

Your continued use of our services after changes are posted indicates your acceptance of the updated Terms. If you do not agree to the updated Terms, please discontinue use of our services.
